The impact of Environmental Law Requirements, principally following EU directives, is all-pervasive and affects a significant portion of our practice area, especially commercial property, corporate mergers/acquisitions and residential development.

In an ever-changing scene, new environmental concerns are always arising and clients are under increasing pressure to take account of environmental risk. Today, planning law and environmental law overlap considerably.  What’s more, the complex web of legislative measures intended for Environmental Protection gives rise to numerous legal issues.  As a result, our Environmental Law practitioners work throughout the practice and are an integrated service as well as a specialist team.  By working in this way, we can help clients, who are dealing with environmental issues in any context, to navigate the complexities and find the best solution.  

We are accustomed to commissioning Environmental audits and advising on environmental assessments. Our people regularly liaise with local authorities and other environmental regulators and advise on integrated pollution control, air pollution control, waste management, landfill, incineration, and contaminated land.

Our all-embracing approach and knowledge enables us to assess the potential environmental implications of a client’s plans with reference to their

specific circumstances.   We can help with:

  • Negotiation of warranties and indemnities to minimise exposure
  • Permit and compliance issues
  • Staff training on internal procedures
  • Drawing up contacts to provide for allocation of risk

We are particularly aware of the concerns of US investors looking at Northern Ireland.

  • One of our team has completed a secondment to the Environmental Policy Division of the Department of the Environment where he was involved in legislative drafting
