Proposals for Developer Contributions for Affordable Housing – a Legal Perspective

The Department for Social Development and the Department for the Environment are currently consulting on significant proposals to require contributions from Developers, in the form of housing units and / or money, before planning permission will  be granted for certain housing development schemes. A system of developer contributions already exists both in the Republic of Ireland and the rest of the United Kingdom. Carson McDowell is hosting a lunch time seminar which will consider the proposals from a planning law perspective, as well as drawing on the experience in other jurisdictions.

The topics covered in the seminar will include:

  • What is proposed in the consultation? 
  • A closer look at the law on planning agreements in Northern Ireland. 
  • Outline of some of the difficulties associated with planning agreements; and
  • Discussion of the corresponding regimes in England and Wales.


Gary McGhee, Partner, Head of Planning Law Team at Carson McDowell. 

Gary is the Head of the Planning and Environmental Law Team within Carson McDowell which he founded over 20 years ago. Gary is one of the few solicitors in Northern Ireland to specialise exclusively in the areas of planning, environmental and energy law. His experience includes the co-ordination of major planning applications; representation at over 50 planning / enforcement appeals and major public inquiries; and instigating / defending judicial reviews of planning and environmental decisions. In addition, Gary is a Legal Associate of the Royal Town Planning Institute, a member of the Environmental and Planning Law Association of NI and a member of the UK Environmental Law Association.

Simon Turbitt, Associate, Planning Law Team at Carson McDowell. 

Simon trained and practised as a solicitor at global law firm Clifford Chance LLP in London, before returning to Northern Ireland to join Carson McDowell in November 2009. Simon practises in the firm’s specialist Planning & Environmental Law Team and as such is involved in, amongst other things, the instigation and defence of judicial reviews of planning decisions, the representation of clients at public inquiries and planning appeals, the co-ordination of major planning applications, and the provision of general planning law advices.

Charles Banner BL, Landmark Chambers, London. 

Charles was called to the Bar of England and Wales in 2004 and to the Bar of Northern Ireland in 2010. He regularly undertakes inquiry, tribunal, High Court and appellate work throughout England and Wales and also acts in litigation before the High Court of Northern Ireland. Charles specialises in planning law, environmental law, administrative and public law, regulatory law, human rights and European Union law.  Charles will provide a commentary on the equivalent regime in England and Wales.
