This briefing will be of interest to all those working in the waste sector and will provide an overview of recent developments in waste legislation (including updates to the Waste and Contaminated Land (Northern Ireland) Order 1997 and the new Pollution Prevention and Control (Industrial Emissions) Regulations 2013), recent consultations (including the Environment Better Regulation Bill and the Waste Prevention Programme), and the Waste Management Duty of Care Code of Practice.
The briefing will also look at some recent waste cases and discuss the increasing use by the NIEA (and other environment agencies) of confiscation orders under proceeds of crime legislation following successful convictions for waste offences.

About the Speakers
Simon is an Associate in the firm’s specialist Planning and Environmental Law team. In addition to providing legal advice on all aspects of planning law, Simon advises clients in respect of their ongoing environmental obligations arising from their waste operations and in respect of alleged breaches of environmental legislation. Simon is also responsible for the quarterly Environmental Law Register which Carson McDowell prepares for the Construction Employers Federation.
Grant McBurney is an Associate in the Planning and Environmental Law team in Carson McDowell specialising in Waste and Contaminated Land matters. Grant advises regularly on Waste Management Licences, Waste Management Exemptions, PPC Permits and other regulatory issues. Grant also defends clients against the increasing number of prosecutions being brought by the NIEA for regulatory offences.
