Court of Justice declares that the European Commission's US Safe Harbour Decision is Invalid

On 6 October, the Court of Justice of the European Union declared that the European Commission’s US Safe Harbour Decision was invalid.  This means that individual European governments can now set their own regulation for US companies' handling of citizens' data and suspend the transfer of data to the US — forcing businesses to host citizens’ data exclusively within their own country.  Businesses transferring data under the safe harbour scheme will need to review how they ensure that data transferred to the US is transferred in line with the law.
